Introduction.

FIRST-HOLD considers the privacy of our users to be of the highest importance. Accordingly, we provide this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of personal information we receive from users of our Site.

FIRST-HOLD is defined as the network of websites and services that are owned and operated by FIRST-HOLD and its subsidiaries, which includes the Venue Listings, and does not include the websites of any of FIRST-HOLD’s participating Venue Managers accessed from the Venue Listings via links.  Unless otherwise noted on the FIRST-HOLD.com Website, each site included within FIRST-HOLD is governed by this Privacy Policy. 

Our Privacy Policy below outlines the type of information we collect and receive from you while you are within the FIRST-HOLD.com Website and using the Service, as well as ways in which we process and, sometimes, share such information and how you can correct or change such information. PLEASE REVIEW THIS PRIVACY POLICY AND THE FIRST-HOLD AGREEMENT CAREFULLY.  YOUR USE OF THIS FIRST-HOLD.COM WEBSITE AS A GUEST TO THE FIRST-HOLD.COM WEBSITE OR, IF APPLICABLE, YOUR USE OF THE SERVICE OR REGISTRATION AS A “USER” SIGNIFIES YOUR AGREEMENT TO THE TERMS OF THIS PRIVACY POLICY. 

IF YOU WISH TO RESERVE A VENUE OR A FACILITY MADE AVAILABLE BY A PARTICIPATING VENUE MANAGER, ANY INFORMATION THAT YOU PROVIDE DIRECTLY TO A PARTICIPATING VENUE MANAGER OUTSIDE OF THE FIRST-HOLD WEBSITE WILL BE GOVERNED BY THE TERMS AND CONDITIONS OF THAT PARTICIPATING VENUE MANAGER’S OWN PRIVACY POLICY.   PLEASE REFER TO THE PRIVACY POLICY OF THAT PARTICIPATING VENUE MANAGER TO DETERMINE HOW THAT PARTICIPATING VENUE MANAGER USES THE INFORMATION THAT YOU PROVIDE TO IT.

1.         How FIRST-HOLD Collects “User Information”.


A.        “Personal Information” you provide to us

“Personally Identifiable Information” is any information that can be used to identify a specific individual, such as your name, email address, home address, and phone number.  FIRST-HOLD asks you to provide such personal data to it in various places throughout the FIRST-HOLD Website.

In addition, we may ask that you provide FIRST-HOLD with additional “Non-Public Personal Information” about you and/or your personal preferences, including, for example, marital status, household income, education and employment status, or how often you plan events, details about the types of facilities or venues you prefer to host your events, how you choose a venue, etc. 

Some of these areas where the collection of such information takes place are listed below:

User Registration:

In order to use many of FIRST-HOLD's features, tools and services, we may ask you to register for a Venue or a Facility or may ask you to register for an account with your own username and password.  During this User registration process, we may ask you for certain “Personal Information”, including both Personally Identifiable Information and Non-Public Personal Information. 

By using the Service or registering as a User of the FIRST-HOLD Service, you agree that FIRST-HOLD may provide to you information about Venues and Facilities offered by participating Venue Managers for you to review.  

Surveys, Polls and Questionnaires:

FIRST-HOLD may offer to you via e-mail online surveys and questionnaires that ask you for “Personal Information” such as your opinion on various issues and feedback on any Venues or Facilities that you have reserved, including the hold process and any booked and completed events at Venues or Facilities.  Occasionally, we may request “Personal Information” such as demographic information (like zip code, age or gender) when you answer a survey.  Such surveys are completely voluntary.

For the surveys regarding your Venue or Facility, you may be asked for “Personal Information” such as how you would rate your overall experience on a five-star system based upon multiple criteria, including Venue or Facility features, quality of the staff, ease of experience, likelihood of recommendation of a friend, why you have decided to use or not use the Venue or Facility again, and other potential metrics. 

B.        “Web Activity Information” gathered by FIRST-HOLD and its third-party service providers

When you visit FIRST-HOLD.com and interact with the services and tools that reside there, FIRST-HOLD may collect information on your actions at the FIRST-HOLD.com Website or “Web Activity Information”. In doing so, FIRST-HOLD may utilize the services of certain third party service providers. 

This type of “Web Activity Information” is generally collected from two sources.  One is from the server log files and the other is from cookies.

  • IP Address

Your IP address is a number that is assigned by your ISP (Internet Service Provider) to your computer to identify its location. We use your IP address to help diagnose problems with our server and to administer our website. We also sometimes use IP addresses to communicate with Users and possibly even ban those Users who are not complying with our FIRST-HOLD Agreement or disable cookies for certain Planners or Users located outside the United States.

  • Cookies

Our site may use a feature of your browser to set a "cookie" on your computer (however, this feature may be disabled in certain circumstances for Planners or Users located outside of the United States). Cookies are small packets of information that a site's computer stores on your computer. FIRST-HOLD can then read the cookies whenever you visit the FIRST-HOLD.com Website. We use cookies to save your password so you don't have to re-enter it each time you visit our site, to deliver content specific to your interests, to track the pages you've visited and to make sure you don't see the same ads repeatedly. These cookies allow us to use the Web Activity Information we collect to customize your FIRST-HOLD experience so that your visit to FIRST-HOLD.com is as relevant and as valuable to you as possible.

You may modify your browser preference to provide you with choices relating to cookies. You have the choice to accept all cookies, to be notified when a cookie is set or to reject all cookies.

If cookies have been disabled for you or you choose to reject cookies, you may be unable to use that part of the Service that requires registration in order to participate or will have to sign in each time you visit FIRST-HOLD.com.

C.        Other Information We Separately Collect:

            From time to time, we may also purchase certain marketing data in order to verify your household information that you provide to us by zip code.  We obtain this information so that we may better serve you with respect to offering to you information about the Venues or Facilities from the participating Venue Managers. 

D.        Online Tracking

            FIRST-HOLD does not use or record any information about Users as they view and move across third-party websites.

2.         Guidelines Regarding Children.

Personal information about children is a concern for all of us. At FIRST-HOLD, we take the protection of children's privacy very seriously. FIRST-HOLD does not encourage participation or visitation by children. Planners who are known to be under the age of 13 are prohibited from registering to become a User and signup for a Venue or Facility.

3.         How FIRST-HOLD Works and How FIRST-HOLD uses the “User Information” it collects.

FIRST-HOLD uses the “Personal Information” and “Web Activity Information” you provide for several purposes, such as to communicate with you and to give you a better experience when visiting FIRST-HOLD.com by personalizing tools, content, services and email messages. FIRST-HOLD also uses this “User Information” to build new services and develop Venues or Facilities that FIRST-HOLD believes are more relevant and valuable to you.

More specifically, when you register with FIRST-HOLD and provide us with Personal Information, including Personally Identifiable Information and Non-Public Personal Information, we provide you with information about Venues or Facilities that have been provided to us by our participating Venue Managers.  You may select from these Venues or Facilities and inquire as to whether certain Venues or Facilities may be made available to you.  Our participating Venue Managers will receive Non-Public Personal Information about you from us in order to determine what Venues or Facilities are available to you.  If you reserve a Venue or Facility, FIRST-HOLD will provide your name and e-mail address to the participating Venue Manager that offers the Venue or Facility. The participating Venue Manager will then contact you directly and may request additional Personal Information, including your credit card information, directly from you in order for you to actually confirm the Reservation.   

In addition, the “Non-Public Personal Information” and “Web Activity Information” collected by FIRST-HOLD is used to create aggregated portraits of the FIRST-HOLD audience, portraits which present anonymous statistical demographic information, but no personal data or Personally Identifiable Information is linked to it. This aggregated information is used, among other things, to determine trends and needs.  For example, we may create a report that tells advertisers that thirty percent (30%) of our Users are males in a certain age range, so that they can determine which of their products or services are most appropriate for our Users.

FIRST-HOLD will also use the aggregated “Non-Public Personal Information” and “Web Activity Information” discussed above, but no “Personally Identifiable Information” linked to it, to supply market research to third-parties, including potential advertisers and participating Venue Managers, to help them understand who the FIRST-HOLD audience is.    

4.         Your Opt-In for Disclosure of “User Information” to Certain Third Parties.

FIRST-HOLD does not sell or otherwise share any User Information with unaffiliated third parties without your consent (Please see “FIRST-HOLD’s Opt-In/Opt-Out Policy” below), except in the following instances:

(i) disclosure of your Non-Public Personal Information to participating Venue Managers in order for participating Venue Managers to determine what Venues or Facilities are available to you;

(ii) disclosure of your name and e-mail address and other identifying information to participating Venue Managers when you confirm that you would like to reserve a Venue or a Facility;

(iii) disclosure as required by applicable law or pursuant to a court or similar order;

(iv) as deemed necessary, in FIRST-HOLD's discretion, to protect the legal rights or the property of FIRST-HOLD, a User or third party, or to prevent personal injury;

(v) in the event of a sale, merger, assignment, joint venture or other transfer or disposition of a portion or all of the assets or stock of FIRST-HOLD or its affiliated entities (including, without limitation, in connection with any bankruptcy or similar proceedings); and/or

(vi) disclosure of aggregate “Non-Public Personal Information” and “Web Activity Information” to third-parties, including potential advertisers and participating Venue Managers, for purposes of market research, market analysis and market information. 

In addition, FIRST-HOLD may provide “Personal Information” to third parties who are providing technical or fulfillment services on behalf of FIRST-HOLD when such disclosure is required in order to provide those services, provided that such third parties agree to be bound by FIRST-HOLD's Privacy Policy.

FIRST-HOLD also reserves the right to share any “User Information” which you provide to (or which is gathered from) FIRST-HOLD with any or all of its subsidiaries and affiliates (collectively, our "Affiliates") (subject to the “opt-out” right described in FIRST-HOLD’s Opt-In/Opt-Out Policy below, with respect to disclosures of “User Information” to Affiliates for their direct marketing uses). FIRST-HOLD will also have access to any information you provide to (or which is gathered from) the web sites of any of our Affiliates.  

In each of the instances described above, you have provided your consent under the terms of this Privacy Policy for FIRST-HOLD to share your Personal Information with the third-parties that are described above.  In particular, if FIRST-HOLD discloses your name and e-mail address to participating Venue Managers when you confirm that you would like to reserve a Venue or Facility, the participating Venue Manager may then contact you about the Venue or Facility.  Please see FIRST-HOLD’s Opt-In/Opt-Out Policy below to see your ability to exercise a cost free right to Opt-Out of FIRST-HOLD’s sharing of your personal information with Venue Managers and Affiliates.   PLEASE NOTE THAT, IF YOU PROVIDE ANY PERSONAL INFORMATION DIRECTLY TO THE PARTICIPATING VENUE MANAGER ONCE IT HAS CONTACTED YOU ABOUT A VENUE OR FACILITY, THE PERSONAL INFORMATION THAT YOU PROVIDE DIRECTLY TO THE PARTICIPATING VENUE MANAGER IS NOT COVERED BY THIS PRIVACY POLICY, BUT IS COVERED BY THE PRIVACY POLICY OF THE PARTICIPATING VENUE MANAGER.      

As stated above, the “Non-Public Personal Information” and “Web Activity Information” you provide on pages of FIRST-HOLD, including those that are co-branded with a third party (including tools that are hosted by a third party), may be shared with third-parties, including potential advertisers or participating Venue Managers, on an aggregated basis, for market research purposes, and in these instances, your permission will not be requested since no personal data or “Personally Identifiable Information” will be shared or provided to these third parties. FIRST-HOLD will, however, use commercially reasonable efforts to contractually require all such third parties to agree not to use any “Non-Public Personal Information” about you, in conjunction with other sources of information, or otherwise, to identify you.

5.         Transfer of Data from Venue Manager to FIRST-HOLD.  

BY MAKING AND CONFIRMING A RESERVATION THROUGH FIRST-HOLD, USER ALSO AGREES THAT THE RELEVANT VENUE MANAGER MAY NOTIFY, AND OTHERWISE TRANSFER INFORMATION TO, FIRST-HOLD REGARDING WHETHER THE USER SHOWED UP FOR, USED, AND PAID VENUE MANAGER FOR, THE VENUE OR FACILITY AND HOW MUCH USER PAID VENUE MANAGER, IF ANY AMOUNT.  FURTHER, USER ACKNOWLEDGES, UNDERSTANDS AND CONSENTS TO, THE FACT THAT, IF THE VENUE MANAGER IS LOCATED OUTSIDE OF THE UNITED STATES, SUCH INFORMATION WILL BE TRANSFERRED BY THE APPLICABLE VENUE MANAGER OUTSIDE OF THE UNITED STATES TO FIRST-HOLD SERVERS LOCATED IN THE UNITED STATES.

6.         FIRST-HOLD’s Opt-in/Opt-out Policy.

            A.        By registering as a User of the FIRST-HOLD Service, you agree that FIRST-HOLD may (i) provide to you for your review Venues or Facilities of participating Venue Managers; (ii) provide to participating Venue Managers your “Non-Public Personal Information” when you have inquired about a Venue or Facility and your name and e-mail address when you have confirmed that you would like to reserve a Venue or Facility from a participating Venue Manager; (iii) contact you in the event of a change in the FIRST-HOLD Agreement, including this Privacy Policy, or to provide you with any Service related notices; and (iv) otherwise provide to you information directly from participating Venue Managers in instances where you have specifically “opted-in” to receive it.

            For purposes of this Privacy Policy, "opt-in" is generally defined as any affirmative action by a FIRST-HOLD User or Planner to submit or receive information, as the case may be.

We currently provide the following “Opt-Out Opportunities”:

  1. At any time, you can follow a link provided in every offer, newsletter or email message (except for e-commerce confirmation or service notice emails) received from FIRST-HOLD to unsubscribe from the Service.     
  2. At any time, you can contact us through info@FIRST-HOLD.com or the address or telephone number referenced in Section 12 below to unsubscribe from the Service and opt-out of our right per your consent under the terms of this Privacy Policy to share your Personal Information with participating Venue Managers and Affiliates as described in this Privacy Policy. 

Notwithstanding anything else in this Privacy Policy, please note that FIRST-HOLD always reserves the right to contact you in the event of a change in the FIRST-HOLD Agreement, including this Privacy Policy, or to provide you with any Service related notices.

At any time, you can “opt-out” of the Service by exercising one of the “Opt-Out” Opportunities” described above and FIRST-HOLD will not share any “Personal Information” about you with participating Venue Managers or Affiliates at any time after the time that you have opted-out.  In addition, if you “opt-out”, FIRST-HOLD will request that each of its third-party participating Venue Managers and its Affiliates delete from their servers the name and e-mail that they have obtained from FIRST-HOLD in order to contact you after your confirmation of interest in a certain Venue or Facility made available by that participating Venue Manager; HOWEVER, AGAIN, PLEASE NOTE THAT, in any case where (A)(i) you have inquired about a Venue or Facility of a participating Venue Manager, (ii) such third-party participating Venue Manager has made the Venue or Facility available to you and (iii) you have confirmed that you would like to reserve the Venue or Facility from the Venue Manager and (B) FIRST-HOLD has provided the participating Venue Manager with your name and e-mail address to contact you, any information that you then choose to provide directly to that participating Venue Manager will be subject to that party’s privacy policy and not FIRST-HOLD’s Privacy Policy.  

If you have additional questions about how one of our participating Venue Managers use information about you, we urge you to contact them directly.

California Users. In addition to the ability to utilize the Opt-Out Opportunities described above, California Users may have the right to request certain disclosure information annually from FIRST-HOLD.  Such disclosure requests should be directed to: General Counsel, FIRST-HOLD, 303 Westminster Road, West Palm Beach, FL 33405.  For more information, please reference the Cal. Civ. Code § 1798.83, available at http://oag.ca.gov/privacy/privacy-laws. In addition, if you are a California resident, in accordance with Cal. Civ. Code §1789.3, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. 

7.         Third Party Advertising and Links to other Sites.

FIRST-HOLD.com may contain links to participating Venue Manager websites or service provider websites that are not co-branded or affiliated with FIRST-HOLD in any way. We cannot be responsible for the privacy practices or the content of such non-FIRST-HOLD websites, and we do not control the practices of any of our participating Venue Managers or service providers to whose sites we link.

8.         Access and Correction.

FIRST-HOLD provides you with the ability to access, correct or change the “Personal Information” in your User portrait at any time, including contact information or other information you've provided to us. To review, modify or delete your FIRST-HOLD Information, please click here. Please be advised that FIRST-HOLD may archive information it collects on its Users and Planners.

9.         How we protect and secure your “Personal Information”.

The importance of security for all “Personal Information” associated with our planners and customers is of utmost concern to us.

First, your access to all of your User “Personal Information” at the FIRST-HOLD Website requires use of your password. We recommend that you do not share your password with anyone.

Second, we exercise reasonable care in providing secure transmission of your “Personal Information” from your PC to our servers and ensuring the security of your information on our systems.   For example, FIRST-HOLD uses industry-standard tools, such as firewalls, in an attempt to make your information secure and confidential.  Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we take steps to protect your information, FIRST-HOLD can't ensure or warrant the security of any “Personal Information” you transmit to us or from our online products or services, and you do so entirely at your own risk. 

10.       United States Website; International Use Limited.

PLEASE NOTE THAT THE FIRST-HOLD WEBSITE IS BASED IN THE UNITED STATES AND IS HOSTED ON SERVERS LOCATED IN THE UNITED STATES.  IF YOU USE THE FIRST-HOLD WEBSITE OR SERVICE FROM OUTSIDE THE UNITED STATES, PLEASE NOTE THAT YOUR INFORMATION MAY BE TRANSFERRED TO AND MAINTAINED ON COMPUTERS AND SERVERS LOCATED OUTSIDE OF YOUR STATE, PROVINCE, COUNTRY, OR OTHER GOVERNMENTAL JURISDICTION, WHERE PRIVACY LAWS MAY NOT BE AS PROTECTIVE AS THOSE IN YOUR JURISDICTION. YOUR CONSENT TO THE FIRST-HOLD AGREEMENT AND PRIVACY POLICY FOLLOWED BY YOUR SUBMISSION OF INFORMATION TO FIRST-HOLD REPRESENTS YOUR AGREEMENT TO THE TRANSFER OF SUCH INFORMATION TO THE UNITED STATES AND THE HANDLING OF YOUR INFORMATION CONSISTENT WITH THIS FIRST-HOLD AGREEMENT AND THE PRIVACY POLICY AND APPLICABLE UNITED STATES LAW.

We control and operate FIRST-HOLD from the United States and make it available for use by United States citizens. FIRST-HOLD.com is not intended to subject us to the privacy laws or jurisdiction of any state, country or territory other than that of the United States.  Please note that we do not represent or warrant that the FIRST-HOLD Website is appropriate for use in any particular jurisdiction.  Those who choose to access the FIRST-HOLD Website do so at their own initiative and are responsible for complying with all local laws, rules and regulations.

11.       Changes to this Privacy Policy.

We will notify our Users when we make any significant changes to our Privacy Policy that affect the use of any Personally Identifiable Information we collect. We will not make new use of any “User Information” which FIRST-HOLD gathered from individual Users or Planners prior to any such significant change in our Privacy Policy without first obtaining the User's or Planner's consent for any new uses.

In instances where we ask for your “Personal Information” and we tell you the data we are collecting on that page will be shared with unaffiliated third parties, and in cases where a User or Planner to FIRST-HOLD.com opts-in to share his/her “Personal Information” with third parties, those disclosures and opt-ins will override anything to the contrary in this Privacy Policy. 

In addition, FIRST-HOLD reserves the right to make non-significant changes to our Privacy Policy that will not affect FIRST-HOLD's use of a user's “User Information” at any time without any notice to you other than posting any such changes in a revised Privacy Policy on FIRST-HOLD.com.

We encourage you to periodically review our Privacy Policy to be sure you are familiar with the most current version.

The Privacy Policy will include the most recent date in which any revision has been made. Please note that this Privacy Policy is also incorporated into the FIRST-HOLD Agreement.

13.       Effective Date.  

This Privacy Policy was last changed on December 17, 2015.
